Terms of service

These terms are an agreement between you and Marcon Digital Pty Ltd (ABN 25 684 266 046, “we”, “us”) in Australia. They cover the Stamus game and the stamus.app website (together, “Stamus”). By playing Stamus or using the site, you agree to them. If you don't agree, please don't use Stamus.

The short version

• Stamus is free to play, with optional in-app purchases.
• You don't need an account. Signing in with Apple or Google only backs up your progress.
• Gold and items are for use in the game only. They have no real-world value.
• Play fair, and don't copy or resell the game.
• Your rights under the Australian Consumer Law always apply.

Who can play

Stamus is made for players of all ages and has a Kids mode. If you're under 18, a parent or guardian must agree to these terms for you and should handle any sign-in or purchases. Settings and the Store sit behind a grown-ups gate.

Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to download Stamus and play it on devices you own or control, for your own non-commercial use.

You must not copy, modify, reverse-engineer, decompile, resell, rent or redistribute Stamus or any part of it, except where the law allows this despite these terms.

Your account

Signing in with Apple or Google is optional. It links your progress to an account so you can restore it on another device. You're responsible for keeping your Apple or Google account secure, because it is the key to your cloud save.

You can delete your account at any time, in the game (Settings → Account → Delete account) or on our website. Our privacy policy explains what we store and for how long.

Gold, items and purchases

Stamus offers optional in-app purchases through the App Store and Google Play. Apple or Google handle payment, and their terms, including their refund policies, apply to your purchase.

• Every purchase shows exactly what you'll get. There are no loot boxes or paid random rewards.
• Gold, gear, heroes and other in-game items, whether earned or bought, are a licence to use in the game only. You don't own them, they have no real-world value, and they can't be sold, traded, transferred or exchanged for money.
• Purchases can be restored on the same Apple or Google account. If you play without signing in and lose or reset your device, progress that wasn't backed up may be lost.
• We may rebalance the game from time to time, which can change how items and gold work.

Fair play

When using Stamus, please don't:

• cheat, exploit bugs or use tools that modify the game or your save to gain items, gold or progress you haven't earned;
• try to access, disrupt or overload our servers, or other people's accounts or data;
• use Stamus to break the law or infringe anyone's rights.

Voice commands

Voice commands are optional. When they're on, the game listens for your battle cry on your device, and any battle cries you record are stored only on your device. Please only record your own voice, or someone's who has agreed to it.

Our content

Stamus, including its name, logo, story, characters, artwork, music and code, belongs to Marcon Digital Pty Ltd or its licensors and is protected by copyright and other intellectual property laws. Stamus and the Stamus logo are trademarks of Marcon Digital Pty Ltd. Third-party assets are used under their licences and credited in the game.

Changes to Stamus

We're always working on Stamus. We may add, change or remove features, content or levels, and we may need to pause or end online features such as cloud save. If we ever stop offering Stamus, we'll give reasonable notice in the game where we can.

Suspending or ending your access

You can stop playing and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms. Where it's reasonable, we'll tell you first and give you a chance to fix things.

Third-party services

Stamus relies on services from others, including Apple, Google and our backend provider, Supabase. Your use of the App Store, Google Play and Apple or Google sign-in is also covered by their own terms.

App Store downloads

If you downloaded Stamus from the Apple App Store, these terms are between you and us, not Apple. Apple has no responsibility for Stamus or its content, and no obligation to provide maintenance or support for it. If Stamus fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); otherwise Apple has no warranty obligation. Apple is not responsible for any claims relating to Stamus, including product liability claims, claims that Stamus fails to meet legal or regulatory requirements, consumer protection claims, or claims that Stamus infringes someone's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you're not located in a country subject to a US Government embargo, and you're not on any US Government list of prohibited or restricted parties.

Your consumer rights

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other laws that can't be excluded. Our services come with guarantees that can't be excluded under that law.

Beyond those rights, Stamus is provided “as is”. We work hard to make it fun and bug-free, but we can't promise it will always be available, uninterrupted or error-free.

Limits on our liability

To the extent the law allows, we aren't liable for any indirect or consequential loss, or for loss of data or progress that wasn't backed up. Where our liability for failing to meet a consumer guarantee can be limited, it is limited to supplying the service again or paying the cost of having it supplied again (for a purchase, a refund of what you paid).

Governing law

These terms are governed by the laws of New South Wales, Australia. You and we agree to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia. If you live elsewhere, you may also have rights under the laws of your country that these terms don't change.

Changes to these terms

We may update these terms. We'll change the date at the top of this page and, for significant changes, let you know in the game. If you keep playing after a change, the new terms apply.
